Legal translation is a translation of legal documents or texts that serve to exchange legal information for people who speak different languages. Legal translation is a difficult form of translation, since all documents of this direction are of a legal nature, and law is an integral part of the social, political and cultural life of the country. Legal translation must be reliable, accurate, in order to correctly convey legal information from one foreign language to another.
By type of documents, the legal translation is divided into:
- Translation of contracts (agreement);
- Translation of normative legal acts;
- Translation of statutes;
- Translation of legal documentation;
- Translation of memorandums;
- Translation of powers of attorney;
- Translation of notarized documents certified by apostille;
- Translation of constituent documents.
The peculiarity of legal translation
Legal translation is a highly specialized direction of translation, which requires an interpreter of high knowledge in the field of jurisprudence and law.
If the translator makes mistakes in the translation of the legal text, this can lead to undesirable consequences, up to the presentation of a lawsuit. Therefore, translators, whom we invite to projects and work on the translation of legal documents, have a higher legal education and experience of translation for more than 10 years. As we have already said, the peculiarity of the legal translation is that the texts in one or another language were compiled according to the legal system of the country where the document was designed and issued. An experienced translator will notice this in the formulations of this legal document.
Translation and editing of legal documents
A qualified interpreter in translation should take into account that the document will be used in another country and within the framework of another legal system. Such features the translator take into account and apply the appropriate wordings.
In legal translation, one can not blindly trust legal dictionaries, since often legal dictionaries offer a translation without specifying the branch of law. Therefore, the legal education of an interpreter dealing with this type of translation is so important, as well as his experience and, as a consequence, the relevance of knowledge.
Proofreading of legal translation by the editor is mandatory, and in our office legal translation is given only to the editor-lawyer. This maximum should be in the translation of legal documents, and strictly performed in our company when legal documents are translated.
The process of legal translation
After completion of the translation and editorial work on it, the document is usually certified by a notary. This action is necessary so that the document can be further used and submitted to official institutions.
If a certified translator who is registered with a notary makes the translation, then a notary, while witnessing the authenticity of the translator’s signature or additionally, the accuracy of the copy of the document certifies such a translation. This is the most common form of witnessing a document.
This service is carried out by our company in the same way as legal translation. When accepting a legal document, the company manager immediately asks the client if it is necessary to certify the transfer in any way. And then the client decides how to reassure. If the client is not sure of the assurance, the manager of the company advises the client free of charge about the assurance, based on the information received from the client: where he will subsequently use this document, or in what structure he will submit.
Example of notarized translation:
There are still two types of translation assurance, but they are used less often and in individual cases.
1) If the translation is carried out in court, by a court interpreter, then such a translation is certified by a judge.
2) The Chamber of Commerce and Industry can also certify translations, but only if it is translations of commercial documents.
The type and design of legal translation
Translation of legal agreement or contracts, basically, is made out by formatting “in two columns”. Other legal documents, such as a memorandum, constituent documents, powers of attorney, are formalized in the same way as their original.
Formatting in translation is respected 1 to 1. Everything that is contained in the document, including prints, stamps, signatures, is translated completely.
If you do not need to translate the entire legal document, but only a part, then in this case we translate the part, and when notarized, we design it as “Extract from the document”. This is legal, and you can use such a certified translation formally.
